PINK's letter to the Office of Electronic Communications and the Ministry of Digital Affairs regarding the regulatory body's practices towards commercial real estate entities

On April 15, PINK sent a letter to the Office of Electronic Communications (UKE) and the Ministry of Digital Affairs (MC) regarding the regulatory body's practices towards commercial real estate entities obligated to provide telecommunications access to properties. The letter was sent in connection with the imposition of, in our opinion, excessive obligations on PINK members, owners, perpetual usufructuaries, and managers, as well as cases of premature and unjustified initiation of administrative proceedings. PINK also noted the need to amend Article 21, Section 2a of the Mega Act, concerning the formal requirements for telecommunications undertakings' requests for action by UKE. Furthermore, in connection with Article 15 zzr of the so-called Special COVID Act, in force since April 1, 2020, PINK called for the suspension of deadlines to also apply to the deadlines specified in the Mega Act. PINK also expressed its intention to actively participate in the legislative process related to the implementation of the European Electronic Communications Code (ECEC) into the Polish legal system.
