The Polish Chamber of Commercial Real Estate Association submitted its comments in connection with the ongoing public consultations on the draft act amending the Act on Real Estate Management (no. from the List of Legislative and Programmatic Works of the Council of Ministers: UD424).
PINK supports the direction of actions aimed at increasing the professionalism, transparency, and quality of real estate brokerage services. This is particularly important for transactions involving consumers.
At the same time, the proposed solutions require significant clarification to ensure that the implementation of these goals does not lead to excessive interference with freedom of contract, increased transaction costs, or disruption of established models of professional commercial real estate market operation. Of particular importance here is distinction between the housing market, and professional turnover, where there are entrepreneurs on both sides of the transaction, covering office, commercial, warehouse and hotel properties as well as investment transactions.
