The amendment entered into force on 1 January 2023 laws On October 27, 2022, on extraordinary measures aimed at limiting electricity prices and supporting certain consumers in 2023. Pursuant to the amendment to the aforementioned act made act of December 15, 2022, on special protection of certain gas fuel recipients in 2023 in connection with the situation on the gas market, tenants of commercial premises who are micro-entrepreneurs, small entrepreneurs or medium-sized entrepreneurs within the meaning of the Act of March 8, 2018 - Entrepreneurs' Law, will be able to benefit from the maximum electricity price mechanism, regardless of whether the tenants of the premises are eligible recipients within the meaning of the amended Act.
In the context of the application of the above-mentioned provisions, many practical problems arise, for example related to submitting a declaration of using the maximum price, which is a condition for applying this price, and to mutual settlements between landlords and tenants.
