The Polish Chamber of Commercial Real Estate (PINK) brings together participants of the commercial real estate market - developers, investors, property managers, architecture companies, construction consultants, real estate market advisors and legal, tax and financial services companies. PINK enables them a real impact on the surrounding economic, political and social environment. PINK is both representative of the industry as well as a platform for cooperation, exchange of experience and knowledge.

About us

The commercial real estate industry is an important branch of the economy, dynamically developing over the last 30 years, with assets worth over PLN 250 billion.

The Polish Chamber of Commercial Real Estate (PINK)enables the associated entities to really influence the surrounding economic, political and social environment. The pretext for establishing together was the challenging in 2016 the correctness of the VAT refund in historical transactions on the commercial real estate market. As result of the activities of, among others, together (correspondence and meetings, publications, report), the Ministry of Finance issued a letter, after which the questioning of the transaction was stopped. As result of these activities, since 2018, together has also dealt with other legislative topics affecting the commercial real estate market.

The aim of together is to bring together representatives of the commercial real estate market sectors, i.e. office, warehouse, retail, hotel and PRS in one organization, that would be both their representative and a platform to exchange experience, knowledge and cooperation.

Members of together include developers, investors, property managers, design companies and construction consultants, real estate market advisors as well as legal, tax and financial advisory companies.

Mission and Goals

The mission of Polish Chamber of Commercial Real Estate (PINK) is to represent developers, investors and service providers in the commercial real estate sector in the economic, political and social environment. We cooperate with other national and international organizations, and in this way we want to promote good practices and standards for the activities in the commercial real estate market.

The aim of together is:

  • influence on the process of shaping a law by issuing opinions on assumptions and legislative projects, affecting the rights and interests of entities related to the commercial real estate industry,
  • cooperation with local authorities, state administration and international organizations in all matters related to the, broadly understood, commercial real estate industry,
  • creating a friendly social climate for solutions proposed by the commercial real estate industry,
  • creating a platform for cooperation between entities from the commercial real estate industry in order to exchange experiences and knowledge.

Activities

The Polish Chamber of Commercial Real Estate (PINK) undertakes a number of activities both on its own initiative, at the request of its members, and as part of cooperation with other industry organizations, state and local administration. It also is a patron of many initiatives and events.

Selected activities we carry out:

  • conducting talks with appropriate state institutions on issues affecting the activities of entities related to the commercial real estate industry,
  • cooperation with ministries, issuing opinions on legislative changes, providing information and reports supporting our position in the industry.
  • organizing meetings, conferences and webinars for entities operating on the commercial real estate market, as well as participating in such events,
  • cooperation with people, entities and organizations supporting similar goals,
  • supporting economic initiatives and projects of members related to the commercial real estate industry,
  • maintaining relations with the media,
  • running an informative website and social media profiles.

The main topics we covered

  • VAT on asset transactions – 2016-2018 (meetings, report and correspondence);
  • FINN (equivalent to REIT) - 2018 (report and comments); since 2020, cooperation with the REIT Association; in April 2021, together with the REIT Association, development and submission to the Ministry of Labor and Technology Development of guidelines to the Act; participation as an external expert in the meeting of the inter-ministerial team for the act in July 2021;
  • withholding tax (WHT) - correspondence 2019 and 2020;
  • the so-called building regulation and construction project issues – opinions February and July 2020, December 2021;
  • so-called mega-act - 2019 and 2020 (comments, parliamentary committees and trainings, correspondence with UKE); April 2021 - preparation of a report entitled "Telecommunications access to commercial buildings" developed in cooperation with Dentons Europe, Arcadis Polska, Ghelamco Poland, Globalworth Poland, HB Reavis Poland, Knight Frank and Skanska Property Poland; since August 2021, ongoing activities together with Łukaszewicz Kancelaria Adwokacka aimed at avoiding provisions unfavorable to building owners (correspondence and meetings with the Chancellery of the Prime Minister and UKE);
  • so-called anti-crisis shields - March - July 2020 (submitting comments, proactive publication of postulates such as issues of lack of symmetry in the treatment of property owners and tenants, support for the sector, abolition of inertia by authorities);
  • EECE (European Electronic Communications Code) in the context of amendments to the mega-act - August 2020;
  • retention fee - September 2020
  • income tax - September-October 2020 (letters, report and expert opinion sent to the Ministry of Finance, submitting comments, webinar and statements in the press), August 2021 (letter on comments to the draft act of July 26, 2021 amending the act on personal income tax, the Corporate Income Tax Act and some other acts), July 2022 (submission of comments as part of public consultations on amendments to the Corporate Income Tax Act and some other acts);;
  • perpetual usufruct - June-July 2021 (letters sent to the Ministry of Justice and the Ministry of Development, participation of PINK members in the debate organized by Rzeczpospolita); further letters on ownership consents to the Ministry of Development - November 2021 and to the Ministry of Finance - December 2021 and March 2022;
  • return to the office - taking the initiative of PINK members regarding the social campaign - November-December 2020; campaign conducted during EFNI, press releases - autumn 2021; April, May and September 2022 – debates broadcast live;
  • consultation on the revision of Directive 2010/31/EU on the energy performance of buildings - June 2021 (submission of comments to the document developed in cooperation with member companies);
  • amendment to the Spatial Planning and Development Act - January 2021 (participation in the debate, comments submitted as part of the pre-consultation), May 2022 (extensive comments submitted as part of the consultation); participation of the representative of the Ministry of Development, Director Michał Gil in the presentation and discussion panel at the PINK conference in June 2022;
  • ESG and sustainable construction: PINK 2021 report, creation of an ESG working group and organization of a series of webinars in 2022;
  • optimization of energy consumption: August/September 2022 (work on the guide "Energy saving in commercial facilities" and submitting comments as part of industry consultations with the Ministry of Development and Technology).

PAWEŁ TOŃSKI

President of the PINK Management Board

Paweł Toński is the co-founder and President of the Management Board of the PINK Association, as well as the Managing Partner responsible for the real estate team at CRIDO. He has over 20 years of experience in tax advisory, in particular in the area of CIT as well as transactions and restructuring. He advised, among others in developing international and national investment and ownership structures. He actively participated in planning and negotiating dozens of transactions of acquisition, sale or reorganization of assets worth at least several hundred million EUR each. For his achievements, he received numerous awards in the rankings of tax advisors published by Rzeczpospolita and Dziennik Gazeta Prawna - in the following categories: CIT, transaction advisory and M&A consulting. The real estate team led by him in CRIDO won the prestigious Eurobuild Awards in 2017, 2018 and 2019 in the category of the best tax advisor in Poland for the real estate industry.

KINGA BARCHOŃ

Kinga Barchoń is a Partner in the Real Estate Advisory Team of PwC Poland. He has over 20 years of transaction experience, including strategic advisory, financial due diligence, net operating income review, acquisition accounting, review of projections, share purchase agreement review and post deal services. Kinga Barchoń is a qualified accountant (ACCA), a member of the Polish branch of the Royal Institution of Chartered Surveyor (RICS), a member of the Urban Land Institute (ULI), a Certified Fraud Examiner (CFE) and a Certified Internal Auditor (CIA). Her main areas of specialization are: real estate transactions, financial due diligence, the highest and best usability studies, optimization and restructuring of real estate use, strategic consulting. She gained experience in such projects as:

  • transaction services includes more than 200 projects with focus on due diligence projects on targets from the real estate and construction sector,
  • review of finance functions at real estate company, including recommendations relating to systems and outsourcing of certain functions,
  • optimalisation programme for property owners (telecommunication, railway stations) of the real estate functions and portfolios. Leading restructuring of the real estate portfolio of one of the largest banks (200 properties),
  • experience in property efficiency management,
  • expert support in the real estate sector, portfolio/ property restructuring, and construction/ development support services.

WERONIKA GUERQUIN-KORYZMA

Weronika Guerquin-Koryzma is a partner in Baker McKenzie’s Warsaw office. She is the head of the Warsaw Office Real Estate Practice. Weronika advises domestic and international investors, developers, investment funds and financial institutions on real estate transactions in the office, logistics, retail, hotel and residential sectors in Poland and CEE, in the field of acquisitions (including portfolio transactions), real estate M&A transactions, structuring of joint ventures, sale and lease back transactions, as well as consultancy in the development process and in the commercialization of projects..

AGNIESZKA HRYNIEWIECKA-JACHOWICZ

Specialist and manager with 25 years of experience on the commercial real estate market in the field of investment transactions and property management as well as real estate appraisals. Since 2017, he has been running his own business dealing with real estate valuations and consulting. In the years 2004 - 2016, she managed a portfolio of real estate funds worth approximately PLN 1.5 billion in BZ WBK TFI SA, acting as a member of the management board of many special purpose vehicles. Formerly, Director of the Valuation and Consulting Department at DTZ Polska, previously worked at the real estate agency Henry Butcher Sp. z o. o. and in construction sector. A civil engineer by education, a graduate of the Warsaw University of Technology, an authorized property appraiser since 1996 and a real estate broker since 2004, a member of Polish professional organizations. Since 2018, a member of the State Qualification Committee for property appraisers. She completed postgraduate studies at Hallam Sheffield University in property valuation and management and became a member of the Royal Institution of Chartered Surveyor (RICS) in 2002. Member of the Management Board of RICS Poland in 2011 - 2017 and since September 2016 an accredited RICS mediator. Member of the Urban Land Institute (ULI).

ARKADIUSZ RUDZKI

Member of the PINK Management Board

Arkadiusz Rudzki is a Member of the Management Board of the PINK Association and Vice-President for Leasing and Sales, Member of the Management Board of the Skanska office company in Central and Eastern Europe responsible for the rental and sale of investment products as well as real estate portfolio management and cooperation with key corporate clients in the CEE region. He started working at the Skanska office company in 2012 in Poland as a director for leasing and real estate value management, at the same time holding the position of Key Client Director in the company’s management board at the CEE level. Then, from January 2016, he managed Skanska development business in Poland as managing director, remaining on the management board of the CEE region. During this period, the office company in Poland sold 15 buildings for approx. EUR 841 million, leased approx. 387,000 sq m. and commissioned 18 investments with a total area of approx. 402,000 sq m. Arkadiusz Rudzki has 20 years of experience in the real estate market, which he gained while working for leading financial institutions, consulting companies and private equity funds related to this sector. 

KATARZYNA STEINER

Katarzyna Steiner is a Member of the Management Board of the PINK Association and a Financial Director with 20 years of experience working in international corporations in Poland and abroad, including 15 years of experience in the commercial real estate market. He has been managing the finances of SEGRO in Central Europe for five years. SEGRO, a Real Estate Investment Trust (“REIT”), owns or manages a 7 million square meter property portfolio worth £11 billion, and provides services to clients from a wide variety of industries. Before joining SEGRO, she was associated with IVG for nine years, initially at the company's headquarters in Bonn, later in the branch in Warsaw, and earlier with PricewaterhouseCoopers AG in Düsseldorf. She is a member of the Royal Institution of Chartered Surveyor (RICS) and other international organizations associating specialists in the field of commercial real estate and finance. She is a graduate of the University of Gdańsk in the field of Finance and Accounting.
