Draft act amending the Act – Construction Law and certain other acts

The following has been included in the List of Legislative and Programmatic Works: Draft act amending the Act – Building Law and certain other acts.

 Below is a brief description of the assumptions on which the project is based:

  • enabling the construction of single-family residential buildings with a building area above and below 70 m2 based on a uniform procedure;
  • extension of the catalogue of buildings and construction works exempt from the obligation to obtain a building permit and submit a notification:
      • addition to the catalogue of investments exempt from building permits but requiring notification construction parts of a free-standing wind farm, the total height of which is greater than 3 m and not greater than 12 m and the power of which does not exceed the power of the micro-installation, and the distance of its location from the plot boundaries is not less than its total height;
      • in order to combat drought it is proposed that only the construction of outlets to natural streams and the construction of tanks for rainwater or meltwater with a capacity of more than 3 m3 and not more than 10 m3 required notification, while the construction of such tanks up to 3 m3 will not even require notification;
  • creation of a Construction Project Database;
  • introducing penalties for late issuance of demolition permit decisions;
  • streamlining the procedure for putting construction works into operation:
      • it is proposed that an occupancy permit should only be required if the building is to be put into use before all construction works are completed and if the investor himself voluntarily applies for it, even though obtaining an occupancy permit is not required;
      • in other cases, notification of completion of construction would be required;
  • in the field of professional liability in construction;
  • restoration of construction expertise as an independent technical function in construction.

The planned date for adoption of the project by the Council of Ministers is the fourth quarter of 2022.
